Family planning

EB-5 for Indian families:
visas, children and gifted funds.

Whether you live in India, Dubai or elsewhere, start with the facts that shape your family’s EB-5 preparation.

Bring the whole family plan into one conversation.

One principal investment can generally support eligible derivatives; this does not make every family member automatically eligible. Parents are not EB-5 derivatives. Children can have different age issues and every applicant has individual documentation and admissibility requirements.

Check each child’s age-protection requirements.

Unmarried children generally need to be under 21, subject to CSPA. A pending petition does not simply freeze every child’s biological age. We coordinate a child-specific legal review, including what changes at visa availability and which next actions need to be documented. Never plan around an informal “your child is safe” assurance.

Why country of birth affects visa availability.

An Indian-born investor living in Dubai does not automatically join a different visa queue by living in the UAE. Chargeability is usually based on birth, not current residence or passport. Speak to us to coordinate a review of any exception, including a spouse’s chargeability, that may apply to your family.

Read the category, the country and the chart.

The Visa Bulletin separates unreserved EB-5 from reserved rural, high-unemployment and infrastructure categories. Final Action Dates and Dates for Filing have different purposes. For adjustment, USCIS decides which chart can be used for the month. A current reserved category is a dated availability position, not a promise that it will remain current.

Document the donor’s funds and every transfer.

If parents or relatives provide funds, the evidence may need to explain the donor’s lawful acquisition, the gift and every transfer. For a property sale, the original acquisition and any co-owner interest may matter. Multiple donors, accounts or countries can add work. This is a reason to start preparing early, not a reason to omit a transfer.

Plan for U.S. residence and tax obligations.

Permanent residence means planning to maintain a U.S. home and meet residence obligations. Work, school and extended travel need to fit that plan. Continuing a business abroad can raise management, tax, reporting and immigration questions. Obtain cross-border advice before moving assets or relying on a particular travel pattern.

A life together, in the United States.

01 / Together

Live in the U.S. with your family.

EB-5 offers eligible investors, their spouse and qualifying children a route to U.S. permanent residence.

An eligible spouse and unmarried children under 21 may be included, subject to individual requirements and age-protection rules.

02 / Education

Study and work beyond student-visa limits.

Eligible U.S. adjustment applicants may obtain a work permit before EB-5 approval. Once valid, it generally allows internships and jobs without H-1B sponsorship.

Work authorisation must be granted and valid before work begins. Admission and tuition treatment depend on university and state rules.

03 / Possibility

Choose where to live and work.

Permanent residence generally lets you live, study and work in the U.S. without an employer sponsoring your visa. Residence and tax obligations still apply.

Plan residence, travel, business interests and tax obligations with the appropriate advisers before relocating.
