Work without H-1B sponsorship
With a Green Card, you can generally work for different employers, change jobs or start a business without H-1B sponsorship.

About EB-5
Live, work and study in the United States through a qualifying investment. Understand the benefits, work-permit options and rural priority processing—then see what it takes to apply.
The benefits of EB-5
EB-5 is a route to U.S. permanent residence through a qualifying investment that supports American jobs. It lets you pursue a Green Card without an employer sponsoring your application.
With a Green Card, you can generally work for different employers, change jobs or start a business without H-1B sponsorship.
Live, work and study across the United States. Your regional center project’s location does not generally determine where you must live.
Study as a permanent resident. In-state tuition may become available when state and university residency rules are met; admission and lower fees are not automatic.
One principal investment can support applications for you, your spouse and qualifying unmarried children under 21, subject to child-age protection and individual eligibility.
Regional center investments commonly give you policy or management rights without a daily operating role. Your obligations are set out in the project agreements.
Permanent residence can lead to eligibility for naturalisation, generally after five years, subject to residence, physical presence and other requirements.
These are benefits of permanent residence. Initial EB-5 residence is conditional for two years; immigration requirements and U.S. residence obligations still apply.
Already in the United States?
Apply for internships and jobs without H-1B sponsorship once your separate work permit is approved and valid.
Eligible applicants can file for adjustment of status alongside their EB-5 petition and request a work permit. That permit can be approved while the I-526E petition is still pending. This is relevant whether you are applying yourself or funding your child’s application.
Concurrent filing depends on your individual eligibility and visa availability.

Project administration, legal representation, government filing, translation, tax advice and relocation may involve additional costs. Request a written breakdown and an explanation of which costs are refundable.
Statutory inflation adjustments begin on 1 January 2027 and repeat every five years. The minimum for qualifying TEA and infrastructure investments is expected to rise to approximately $900,000–$950,000 from that date, subject to official confirmation.

Qualifying rural investments have a specific processing advantage: U.S. law requires USCIS to prioritise their EB-5 investor petitions.
For a family weighing timing and visa availability, rural projects deserve early consideration. You can generally invest in a qualifying rural project and still choose to live or study in a U.S. city.
Rural priority applies to processing the I-526E petition. It is separate from an individual expedite request. Project review, your evidence, USCIS workload and visa availability affect timing; work permits, adjustment of status and consular processing follow their own review processes.
| Qualifying category | Minimum capital | Reserved visas | Rural petition priority |
|---|---|---|---|
| Rural TEA | $800,000 | 20% | Yes |
| High-unemployment TEA | $800,000 | 10% | No |
| Infrastructure | $800,000 | 2% | No |
| Other qualifying investments | $1,050,000 | Unreserved | No |
Fees are additional. Rural is a type of targeted employment area (TEA). Reserved categories have separate visa allocations. Check the current Visa Bulletin and assess each project’s financial merits separately.
Your application, your family
You do not need a U.S. job offer to pursue EB-5. You do need qualifying capital, evidence of its lawful source and transfer path, and to meet the immigration requirements. We coordinate these checks and keep you informed throughout; a recommended attorney carries out the legal and source-of-funds reviews.
The whole journey, one step at a time
Follow all nine stages here. Select a step for its overview, then open the detail when you need it.
Preparation · within your control
Discuss your family, country of birth, immigration history, objectives and available capital. Identify children whose age requires early legal review.
Who is involved: You + Residency First
Identify the principal applicant, countries of birth, family members’ dates of birth, current U.S. status and prior immigration issues. If a parent is funding an adult child, confirm that the child will be the investor; parents cannot join that case as dependants.
We establish your main point of contact and coordinate the individual eligibility review. Flag study, graduation, work and travel dates early, so the plan reflects your actual circumstances.
A clear service scope, your main contact at Residency First and the issues requiring specialist review.
Preparation · shared with your advisers
Compare qualifying regional center projects. Review project finances, job-creation assumptions, capital structure, offering terms, fees and conflicts. Verify the parties and their respective roles.
Who is involved: Residency First + independent advisers
Read the offering documents, business plan and job report. Examine the developer’s equity, senior debt, completion assumptions, investor repayment priority, extensions, fees and conflicts. Rural classification brings petition priority and reserved visas, but does not establish financial quality.
Compare the total commitment and your liquidity needs, not just the minimum capital. We help organise the comparison and coordinate appropriate independent professional reviews before you decide.
A documented review before any commitment.
Preparation · document-dependent
We help organise records showing how the capital was earned and every material transfer. One of our recommended attorneys carries out the legal review of tax records, business documents, gifts or loans; we coordinate document requests, translations and follow-up.
Who is involved: Residency First + recommended attorney
The records must explain both the lawful origin of the capital and its path to the investment. A parental gift also requires evidence of the donor’s lawful funds, the gift itself and the transfers.
One of our recommended attorneys carries out the legal source-of-funds review. We coordinate the evidence requests, translations and follow-up, keeping you informed about gaps before filing.
A coherent, evidence-backed source and path of funds.
Milestone · coordinated filing
Review subscription and escrow terms, make the qualifying investment or meet the applicable active-investment requirements, and file Form I-526E for the regional center investment.
Who is involved: Recommended attorney + project team, coordinated by Residency First
Review subscription, offering and escrow terms before transferring funds. Keep evidence of each transfer and the filing receipt. Escrow release depends on the project agreements; it is not universally tied to petition approval.
Eligible applicants may file I-485 adjustment of status with I-526E and request a separate I-765 work permit. We coordinate the eligibility review and filings. Filing alone does not authorise work or travel; the work permit needs separate approval and must be valid.
Filed petition and receipt; these do not confer residence.
Government stage · USCIS review
USCIS reviews the I-526E petition and may request further evidence before making its decision. Approval confirms the petition stage. We coordinate updates and check your priority date, category and visa availability for the next residence-processing stage.
Who is involved: USCIS + Department of State
USCIS reviews your I-526E evidence and any responses to requests for further information. When approved, we coordinate receipt of the approval notice and the next steps with your recommended attorney. Qualifying rural petitions receive statutory priority processing.
Track reserved or unreserved visa availability for your country of chargeability, usually your country of birth. A current category can change. Petition approval and an available visa are separate requirements; neither alone completes the residence process.
I-526E approval; visa availability determines when residence can be finalised.
Government stage · individual eligibility
Outside the U.S., complete National Visa Center and consular steps, including the immigrant visa application, medical examination and interview. Eligible applicants inside the U.S. may pursue I-485 adjustment; concurrent filing is available only where the legal and visa-availability conditions are met.
Who is involved: Recommended attorney + government; preparation coordinated by Residency First
Visa application → interview → admission
I-485 application → USCIS decision
When eligible and a visa is available, complete National Visa Center preparation, DS-260, civil documents, the medical examination and consular interview. Residence begins when you are admitted using the immigrant visa.
Eligible applicants pursue I-485 adjustment, which may already be pending through concurrent filing. An approved work permit can allow work while waiting; adjustment approval grants residence. Coordinate travel and status decisions with us and your recommended attorney.
Admission as a resident or approval of adjustment of status.
Statutory stage · two years
Your initial EB-5 permanent residence is conditional. Plan family relocation, tax matters, travel and document retention while monitoring the investment and jobs.
Who is involved: You + Residency First + recommended attorney
Maintain U.S. residence, organise family settlement and obtain appropriate tax advice. Keep immigration deadlines and project reporting on separate calendars.
Retain investment records, project updates and job evidence needed for removal of conditions. We coordinate preparation and follow-up with the project team and your recommended attorney.
A calendar for residence obligations and removal of conditions.
Filing window · before the second anniversary
Generally file during the 90 days immediately before the second anniversary of obtaining conditional residence. We coordinate the evidence collection and follow-up with a recommended attorney, who prepares the legal submission concerning the investment and required jobs. Processing may extend beyond the initial card period; follow current USCIS documentation guidance.
Who is involved: Recommended attorney + project team, coordinated by Residency First
Diagram is not to scale. I-829 adjudication can continue beyond the initial card period.
I-829 generally belongs in the 90-day window immediately before the second anniversary of conditional residence. We coordinate the project and investor records; a recommended attorney reviews the evidence and prepares the legal submission.
Adjudication may continue beyond the initial card period. Follow current USCIS documentation guidance for evidence of status and travel. I-829 is an immigration filing, not a request for investment repayment.
A request to remove conditions, not an investment repayment request.
Ongoing · your family’s priorities
After removal of conditions, continue to maintain residence and meet tax and reporting obligations. Review education, employment, business interests and travel plans. Follow project reporting and contractual exit terms separately.
Who is involved: You + Residency First + relevant specialists
If I-829 is approved, the conditions are removed. Investment repayment follows the project’s terms and performance; it is not triggered by immigration approval.
Continue to meet U.S. residence, tax and reporting obligations. If citizenship is a goal, review the separate naturalisation requirements, including continuous residence and physical presence, before planning around eligibility.
Monitor investor reports, contractual extensions and the proposed exit. Immigration approval does not trigger capital repayment. Financial recovery and timing depend on the project’s terms and performance.
An enduring U.S. residence plan and informed investment monitoring.
Preparation can overlap. Eligible applicants in the U.S. may file concurrently; USCIS review and visa availability determine the government stages.

EB-5 is the U.S. employment-based immigrant investor category. An eligible investor makes a qualifying investment in a new commercial enterprise that meets the required job-creation rules, then pursues permanent residence through the relevant immigration process.
Your eligible spouse and unmarried children under 21 can generally be included, subject to individual requirements and Child Status Protection Act rules. Each derivative needs a visa number. Permanent residence can support the freedom to live, work and study in the U.S.; school admission and tuition treatment are separate matters.

A TEA is a qualifying rural area or a high-unemployment area designated under the federal rules. A rural area is outside a metropolitan statistical area and outside the boundary of a city or town with 20,000 or more people. High-unemployment designation uses qualifying census tracts and at least 150% of the national average unemployment rate. A project’s marketing label alone is not sufficient.
Rural is a type of targeted employment area (TEA). The area must be outside a metropolitan statistical area and outside the boundary of a city or town with a population of 20,000 or more. A project must support the claimed classification; a rural label alone is not enough.
The statutory infrastructure category involves a public works project administered by a governmental entity acting as the job-creating entity under the regional center framework. Not every private project that includes roads, utilities or other infrastructure qualifies. We coordinate an attorney’s review of the specific designation and supporting documents.
Benefits and naturalisation: USCIS · Welcome to the United States. Rural priority and reserved visas: 8 U.S.C. 1153(b)(5)(E)(ii)(I) and (B)(i), in the statutory text above.
Check eligibility for your spouse and each child at the outset. Children must generally be unmarried and under 21, subject to CSPA calculations. A child approaching 21 needs a specific assessment of age, petition timing, visa availability and the seek-to-acquire requirement.
USCIS revised its CSPA age-calculation policy effective 15 August 2025. The Final Action Dates chart generally determines visa availability for the new policy, with transitional treatment for certain adjustment applications already pending before that date. Speak to us to coordinate a case-specific review of the applicable rule and any action needed.

We work exclusively with the EB-5 Regional Center Program. We no longer offer Direct EB-5.
The qualifying capital threshold depends on the investment category, not simply the choice of route. Project, professional and operating costs vary; Direct EB-5 does not automatically mean a lower total commitment.
A regional center project brings together a sponsor, project team and investor reporting. We help you examine their experience and responsibilities. Regional center designation is not insurance or a government endorsement.
Regional center cases may use permitted economic models to count qualifying direct and indirect jobs. Direct EB-5 generally relies on qualifying employees of the enterprise; independent contractors are not its direct employees.
A pooled regional center investment commonly gives you defined management or policy rights without running the project day to day. Review the agreements: investor obligations still apply.
Our service covers regional center investments and Form I-526E. We coordinate preparation and specialist reviews and stay your main point of contact.
Approximately 59% of standalone decisions were denials in FY2025.
The investment must create at least 10 qualifying full-time positions for eligible U.S. workers. Full-time generally means at least 35 working hours per week. The investor and their spouse or children do not count toward the requirement; nonimmigrant workers do not qualify merely because they have work authorization.
Regional center cases may use accepted economic models, with statutory limits on indirect jobs and additional rules for short-duration construction activity.
Ask how jobs are calculated, when they are expected to be created, how they are allocated to investors, and what margin exists if the project underperforms. A forecast is not proof that the required jobs will actually materialize.

Your evidence should tell one consistent story. Employment income, business distributions, property sales, inheritance, gifts and loans each need appropriate records. A gift does not remove the need to evidence the donor’s lawful source. One of our recommended attorneys reviews loan structures and supporting evidence, with us coordinating the document preparation and follow-up.
Expect review of relevant tax filings, bank statements, ownership records and transaction documents. Address missing records and third-party transfers early. Send sensitive documents only through an agreed secure process.
I-526E is the investor petition used for the EB-5 Regional Center Program. We coordinate preparation and filing with your recommended attorney. Approval confirms the petition-stage requirements; it does not itself grant a green card.
When eligible and a visa is available, consular processing usually involves the National Visa Center, Form DS-260, civil documents, medical examination and an interview. Permanent residence begins on admission to the U.S. using the immigrant visa.
An eligible person may apply for adjustment of status using Form I-485. Concurrent filing with an investor petition may be possible where the legal requirements and applicable filing-chart rules allow it. A petition alone does not give lawful status, work permission or travel authorization.
Eligible applicants in the U.S. can request an adjustment-based work permit using Form I-765 while I-485 and the EB-5 petition are pending. Once approved and valid, that permit generally allows internships and jobs without H-1B sponsorship. Filing alone does not authorise work. Eligibility, visa availability and current status need individual review.
Initial EB-5 permanent residence is conditional for two years. The I-829 petition seeks removal of conditions and is generally filed in the 90 days immediately before the second anniversary of obtaining conditional residence. We coordinate the preparation and follow-up; a recommended attorney reviews investment and job evidence, family inclusion and the current filing rules.

Your priority date generally comes from the proper filing of your investor petition. Visa availability depends on that date, your category and your country of chargeability, usually your country of birth. Living in Dubai or holding another passport does not automatically change that allocation.

|---|---|
| Rural reserved | 20% |
| High-unemployment reserved | 10% |
| Infrastructure reserved | 2% |
| Unreserved | 68% |
For Indian-born applicants: the reserved rural, high-unemployment and infrastructure categories are current in the October 2026 bulletin. If your investment qualifies and a visa remains available when your case is ready, you may proceed after I-526E approval without an additional visa-number backlog. Consular processing or adjustment approval is still required; filing now does not lock in future availability. India’s unreserved category has a separate cutoff.

“Current” means visa numbers are available for otherwise qualified applicants in that category; it does not mean immediate adjudication. Dates may move backwards, and a category can become unavailable.
The Final Action Dates chart and Dates for Filing chart do different jobs. For adjustment of status, check which chart USCIS permits for the month. Your priority date must be earlier than a listed cutoff.
Review the private placement memorandum, subscription agreement, business plan, economic report and capital structure with the appropriate independent advisers. Understand the developer’s equity, senior debt, completion risk, security, repayment priority, fees and conflicts of interest.
Ask who holds the money, what releases it, where it goes next and what refunds are available. Project funds support development and qualifying job creation. The private offering and escrow agreements set the release conditions; these may include a USCIS receipt for the I-526E filing and other requirements. There is no universal release date: review the terms of your selected project. Escrow is a contractual mechanism, not insurance against loss.
The capital must remain exposed to investment risk and satisfy the applicable sustainment requirements. Rules differ by filing date and can be affected by current policy or legal developments. We coordinate a legal review of the period that applies to your case. A statutory immigration period is not a contractual promise that your capital will be returned on that date.
Repayment depends on the project’s performance, capital structure and governing documents. Review extension powers, refinancing assumptions, sale conditions and any further deployment of capital. Neither a green card nor removal of conditions guarantees financial recovery.
Ask about investor reporting, remedies and escalation before investing. We coordinate a legal assessment of any statutory protections that may apply to the particular event and investor. Do not assume that a project change, replacement investment or regional center issue can be resolved without immigration consequences.

Plan U.S. residence, business commitments abroad, schooling, healthcare and travel before relocating. Long absences may raise questions about maintaining permanent residence. A re-entry permit is not a blanket assurance against abandonment.
Sources: IRS · green card test for tax residence
U.S. permanent residence generally brings federal tax residence under the green card test. Worldwide income, foreign accounts and business interests may create reporting obligations. Obtain U.S. and home-country tax advice before transferring assets or changing residence.
Keep immigration deadlines and project reporting on separate calendars. Your family’s right to remain in the U.S. and the financial performance of your investment are related in some respects, but they are not the same outcome.
You are making an at-risk investment and applying under immigration rules. Investment alone does not establish eligibility or approval.
Eligible derivatives can generally accompany one principal investor’s case. Government, legal and practical costs can still vary by family member.
Purchasing a home for personal use does not itself satisfy the EB-5 enterprise and job-creation requirements.
A current visa category concerns visa-number availability. Petition review, admissibility and other procedures still apply.
Immigration milestones do not trigger automatic repayment. Project documents, performance and applicable sustainment rules need separate review.

The current minimum qualifying investment is $800,000 in a targeted employment area or eligible infrastructure project, or $1,050,000 otherwise. Budget separately for project administration, legal, filing, translation and relocation costs. These fees do not normally count toward the qualifying capital. Statutory inflation adjustments begin on 1 January 2027; reconfirm the amount that applies when you file.
Yes. EB-5 capital must be at risk, and you can lose some or all of it. Review the project’s financing, borrower, security, senior lenders, construction assumptions and exit strategy with independent professionals. Immigration eligibility does not establish investment quality.
No. A projected maturity date or a developer’s track record does not guarantee repayment. The offering documents govern extensions, exit conditions and distributions. Meeting immigration requirements does not force a project to return capital.
Escrow is an arrangement under which a third party holds money until specified contractual conditions are met. Read the release triggers, refund provisions, fees and consequences of a denial. Money may be released before your petition is approved. Escrow does not make an investment risk-free.
Both your capital and your immigration case can be affected, particularly if required jobs are not created. Recovery depends on assets, creditor priority and legal rights. We coordinate a review of applicable protections and possible remedial steps with a recommended attorney; a replacement project or recovery is not automatic.
Generally the qualifying investment is made by the principal investor, and eligible spouse and unmarried children can pursue derivative residence. The family still has individual eligibility, documentation, visa-number and fee requirements. Use our family cost planner to distinguish capital from additional costs.
A home bought for personal use does not itself satisfy EB-5. The investment must meet the commercial-enterprise and job-creation rules. A qualifying property development investment is a different structure.
A regional center investment commonly provides defined management or policy rights rather than a daily operating role. We coordinate a review of your obligations under the project agreements.
No. USCIS assesses your eligibility, investment, lawful source and path of funds, and job-creation evidence. Petition approval is a separate step from visa issuance or adjustment of status. Admissibility checks and visa availability still apply.
Contact us promptly. We coordinate an immediate legal review of the written decision and any motion, appeal or refiling deadlines. A denial does not automatically trigger a full refund. Refund rights, deductions and timing depend on the project documents and any escrow agreement.
There is no reliable single duration for every family. Document readiness, petition type, requests for evidence, USCIS workload, country of chargeability and visa availability all matter. Preparation is partly controllable; government adjudication and visa queues are not. Speak to us for a coordinated review of current, case-specific estimates.
Qualifying rural I-526E petitions receive statutory priority processing. Priority applies to petition adjudication and is separate from an individual expedite request. Rural investments also have a 20% reserved visa allocation. Priority does not automatically expedite a work permit, adjustment of status or consular processing, and visa availability still matters.
Eligible applicants in the U.S. can request a separate adjustment-based work permit while their I-526E petition is pending. Once approved and valid, it generally allows work without H-1B sponsorship. Filing a petition or work-permit request alone does not authorise employment. Speak to us to coordinate the review of your status, immigration history and visa availability.
A priority date generally establishes your place in the immigrant visa queue and is usually the date USCIS properly receives your investor petition. When a category has a cutoff, your date must be earlier than the relevant cutoff. A current category does not mean immediate approval.
Visa allocation usually follows country of birth, not current residence or passport. In the October 2026 Final Action chart, unreserved EB-5 has cutoffs for mainland China and India; all three reserved categories are current for all listed countries. This is a dated snapshot, not a forecast. Check the latest Department of State bulletin and the USCIS filing chart each month.
An eligible spouse may generally immigrate as your derivative beneficiary. Each family member must satisfy applicable requirements and needs a visa number. We coordinate the timing and documentation review for each family member.
Generally, unmarried children under 21 may qualify as derivatives. The Child Status Protection Act can affect the age calculation, but protection is not automatic. Bring each child’s date of birth, marital status and immigration history to your consultation.
Biological age alone may not determine eligibility. We coordinate a specialist legal review of CSPA age, visa availability, the seek-to-acquire requirement and the policy that applies. USCIS changed its age-calculation approach effective 15 August 2025, with transitional treatment for certain already-pending adjustment applications. Do not rely on a filing date alone to protect a child.
With a Green Card, eligible family members can generally live, study and work without H-1B sponsorship. Eligible applicants in the U.S. may obtain a separate adjustment-based work permit while their EB-5 petition is pending. Once valid, it can cover internships and jobs; filing alone does not authorise work. Tuition and admissions rules vary by state and institution.
Parents are not derivative beneficiaries of your EB-5 petition. Eligible spouses and unmarried children may qualify, subject to the applicable rules. Discuss each family member with us so we can coordinate the eligibility review; do not assume the entire extended family is included.
Permanent residents can generally choose where to live in the U.S.; your EB-5 project location does not generally dictate your home address. Review actual investment responsibilities and maintain U.S. residence. University tuition and state residency benefits follow their own eligibility rules, separately from your project’s location.
We help organise the records and coordinate the source-of-funds review. One of our recommended attorneys reviews how the money was lawfully earned or acquired and traces its movement to the investment. Evidence can include tax returns, business records, salary and dividend statements, sale agreements, inheritance or gift documents, and bank transfers. Loans and gifts need their own evidence; unexplained transfers should be addressed before filing.
U.S. lawful permanent residence generally brings U.S. federal tax residence under the green card test, subject to applicable rules and treaties. Worldwide income and foreign asset reporting may be relevant. Obtain U.S. and home-country tax advice before moving, transferring assets or restructuring a business.
It may be possible, but an overseas business must be planned around U.S. residence obligations, travel, tax reporting and management arrangements. Long or repeated absences can raise abandonment questions. Bring your actual travel pattern to us; we coordinate input from a recommended immigration attorney and cross-border tax advisers.
Your initial EB-5 permanent residence is conditional for two years. Plan the I-829 filing, preserve investment and job-creation records, monitor the project, and maintain U.S. residence. You also need to manage tax filings, address updates, travel documents and family settlement. Removal of conditions and investment repayment remain separate matters.
The initial consultation is free. Request a written scope and complete fee and compensation disclosure before engaging or investing, including any project-paid commissions and separately retained specialists.
Usually not. Country of chargeability is generally based on birth, not your current residence or passport. Exceptions require individual legal review.
